LIVING THE UPSIDE HERITAGE DAY MAPONYA MALL TERMS AND CONDITIONS

TERMS AND CONDITIONS

1.1. Thank you for contributing to the Living the Upside initiative. Your generous donations assist us in aiding those in need through trusted local charities. Please read the Terms and Conditions below to ensure that your contributions can be safely and effectively distributed.

1.2 These Terms and Conditions govern the Living the Upside donation initiative operated by Maponya Mall. By donating, donors acknowledge and agree to be bound by these Terms and Conditions.

2. Purpose and Service Description

2.1. The Living the Upside initiative is a community upliftment programme supporting the children of Othandweni Children’s Home.

2.2. Donation boxes are available at Maponya Mall, inviting the community to donate gently used clothing, baby items, books, and stationery.

2.4. Donation boxes are accessible during official trading hours:

Monday – Thursday: 09h00 – 18h00
Friday: 09h00 – 18h00
Saturday: 09h00 – 17h00
Sunday & Public Holidays: 09h00 – 16h00

2.5. Maponya Mall will collect and distribute all donations to vetted, registered non-profit organisations, including Othandweni Children’s Home and/or other approved charitable partners.

2.6. This initiative will run from 1 September 2025 to 30 September 2025, during official trading hours, unless otherwise communicated.

3. Eligibility

3.1. Open to all members of the public visiting Maponya Mall. 3.2. Donations must be securely packaged (preferably in clear bags) before being placed in boxes.
3.3. Commercial or bulk donations require prior arrangement with mall management.

4. Accepted Donations

4.1. Items accepted include (but are not limited to) gently used baby clothing, books, and stationery. 4.2. All items must be clean, wearable, and free of significant damage.
4.3. Items not meeting hygiene, safety, or quality standards may be responsibly discarded or recycled at Maponya Mall’s discretion.
4.4. Prohibited items include:

Perishable goods

Used undergarments (unless new and sealed)
Hazardous substances or sharp/flammable objects
Electronics, weapons, or monetary donations
4.5. Donors warrant that they are the lawful owners of the donated items.
4.6. Maponya Mall reserves the right to determine the acceptability of any donation.

5. General Terms

5.1. All donations become the property of Maponya Mall upon deposit. 5.2. Maponya Mall reserves the right to modify, relocate, or discontinue the donation boxes without notice.
5.3. Donors will not be notified of the final destination of their specific contributions.
5.4. Items unsuitable for redistribution may be recycled, discarded, or repurposed for other charitable initiatives.
5.5. No returns or compensation will be offered.

6. Donor Responsibilities

6.1. Donors must ensure only appropriate items are placed into donation boxes. 6.2. Misuse, vandalism, or illegal dumping will be reported to authorities and may lead to prosecution.
6.3. Donations must not be left outside of the boxes for safety, security, and hygiene reasons.

7. Limitation of Liability

7.1. Maponya Mall, its owners, staff, and affiliates shall not be liable for:

Lost, stolen, or damaged donationsDonations left outside of designated boxes

Losses incurred by donors due to disposal of items
Any injury, damage, or liability arising from inappropriate use of donation areas

7.2. No tax receipts, valuations, or proof of donation will be issued.
7.3. Maponya Mall disclaims responsibility for the condition, distribution, or final use of donated items once transferred to partner organisations.
7.4. Donations are made entirely at the donor’s own risk.

8. Indemnity

8.1. Donors indemnify and hold harmless Maponya Mall, its employees, and affiliates against any claims, damages, or liabilities arising from the ownership, condition, or origin of donated items. 8.2. Donors are liable for any breach of responsibilities outlined in Clause 6.

9. Privacy and Anonymity

9.1. Maponya Mall will not collect personal information unless voluntarily provided (e.g., newsletters, donor logs). 9.2. Any personal data collected will be processed in accordance with the Protection of Personal Information Act, 2013 (POPIA). 9.3. Donors’ identities will remain confidential unless expressly agreed otherwise.
9.4. Donors must not include personal documents or items containing personal information.

10. Compliance and Safety

10.1. Donation boxes will be placed in safe, accessible, and clearly marked areas. 10.2. Donations must comply with public health, fire safety, and waste management regulations.
10.3. Inappropriate or offensive items will be removed and disposed of.
10.4. Any health or safety risks arising from misuse will be reported to local authorities and may result in suspension of the service.

11. Changes to Terms

11.1. These Terms and Conditions are subject to change at any time. 11.2. Updated terms will be available on the Maponya Mall website and/or at donation box locations.
11.3. Continued participation following changes constitutes acceptance of the revised terms.

12. Public Communication

12.1. These Terms and Conditions will be available at www.maponyamall.co.za. 12.2. Maponya Mall may publicly announce the names of recipient organisations and share updates via media platforms.
12.3. General photographs of donation activities may be used for promotional purposes.

13. Service Availability

13.1. Donation boxes will be available for 31 days during trading hours, subject to operational review. 13.2. Temporary closures (e.g., relocation or maintenance) will be communicated via in-mall signage and/or official platforms.
13.3. Maponya Mall reserves the right to suspend, relocate, or terminate the initiative at its discretion.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
